Terms of Service

1. Acceptance of Terms

By accessing or using the NeedSpace platform (operated by NeedSpace AI Systems Private Limited), including our WhatsApp-based service, website, and any related services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Definitions

"Platform" refers to the NeedSpace WhatsApp-based rental transaction service, website, and associated tools.
"Owner" refers to a user listing a property for rent.
"Tenant" refers to a user searching for a rental property.
"Rental Guarantee" refers to our managed risk-sharing service (NOT insurance).
"Verification" refers to the mandatory KYC and identity verification process.

3. Eligibility

You must be at least 18 years of age and a resident of India to use NeedSpace. By using our services, you represent and warrant that you meet these requirements and have the legal capacity to enter into binding agreements.

4. User Accounts & Verification

All users must complete KYC verification including government ID and live selfie. You agree to provide accurate, current, and complete information. Providing false or misleading information will result in immediate account termination and may result in legal action.

5. Owner Obligations

Owners must provide accurate property details, genuine photographs (entrance, living room, bedroom, utility areas), and complete KYC verification before a listing can be published. Owners are responsible for the accuracy of their listing information.

6. Tenant Obligations

Tenants seeking rental guarantees must complete full verification including identity documents, live selfie, employment details, income proof, and residence history. Tenants must provide truthful information — falsification will result in guarantee revocation.

7. Payments

The following fees apply:

• Video Call Booking: ₹199 — non-refundable after successful connection
• Physical Visit Booking: ₹999 — non-refundable after visit confirmation
• Guarantee Fees: As per the selected tier (BASIC, FLEX, or ZERO DEPOSIT)

All payments must be confirmed before any booking is processed. No booking shall be made without confirmed payment.

8. Rental Guarantees

Guarantee eligibility is determined by our proprietary risk scoring model. Guarantee tiers and eligibility:

• BASIC: Available to LOW, MEDIUM, and HIGH risk tenants
• FLEX: Available to LOW and MEDIUM risk tenants only
• ZERO DEPOSIT: Available to LOW risk tenants only

VERY HIGH risk tenants are not eligible for any guarantee. Verification status must be VERIFIED before any guarantee can be issued.

9. Prohibited Conduct

Users shall not:

• Provide false identity documents or information
• Attempt to manipulate or abuse the risk scoring system
• Use the platform for any unlawful purpose
• Attempt to bypass payment or verification requirements
• Harass, threaten, or abuse other users
• Use automated tools to access the platform without authorization

10. Limitation of Liability

NeedSpace acts as a facilitator between owners and tenants. We are not a party to any rental agreement between users. To the maximum extent permitted by law, NeedSpace shall not be liable for any indirect, incidental, or consequential damages arising from use of our services.

11. Termination

We reserve the right to suspend or terminate any user account for violation of these terms, fraudulent activity, or guarantee abuse, without prior notice.

12. Modifications

We may modify these Terms at any time. Changes will be posted on this page. Continued use of the platform after changes constitutes acceptance.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Shivamogga, Karnataka.
